Overview of HIPAA Portability

The Health Insurance Portability and Accountability Act (HIPAA) is a federal law that includes certain rights and protections for employees enrolled in group health plans.  The portability rules include prior coverage credit for pre-existing condition limitations, special enrollment rights, and nondiscrimination due to health factor rules.

HIPAA nondiscrimination rules are a major hurdle for employers who want to structure employee health plan contributions that are based on health factors, such as discounted rates for nonsmokers.  However, with a properly designed wellness program, employers can implement different levels of contributions based on health factors and still be in compliance with HIPAA’s nondiscrimination rules.

As your broker, Keller advises you on HIPAA portability compliance and assists you with the implementation of wellness programs.  For more detailed information, please contact your Keller consultant or visit the Client Portal
