Be sure to consider all of the plan design requirements before charging employees more for medical coverage if they smoke or use tobacco. A recent blog article by SelfHelpWorks discusses the law suit against Macy’s regarding its smoking cessation program. The article does a nice job of explaining the “Reasonable Alternative Standard” requirement, necessary in wellness programs, and why the Department of Labor says Macy’s program is not compliant.
