The Department of Labor (DOL) Wage and Hour Division (WHD) has published a Final Rule amending the Fair Labor Standards Act (FLSA). The Final Rule updates the minimum requirements for an employee to qualify as exempt from the overtime pay protections provided by the FLSA. The primary change was to increase the minimum salary requirements for exempt status. Included in the Final Rule are provisions to automatically increase the salary level requirements every 3 years starting with January 1, 2020.
