Election Impact on the ACANovember 11, 2016
Given the federal election results and the stated intentions of Republican leadership, a full or partial repeal of the ACA is likely to be passed by Congress and would not be vetoed. At this time, it is our understanding that tax-related provisions, such as the individual and employer mandates, could be repealed early in the new year. Even if this is the case, the repeal provisions may be phased in while Congress designs a replacement plan to ensure millions of Americans do not lose coverage. We are monitoring the status and will provide more details as they become available.
For our clients subject to the employer mandate, 2016 Form 1095 reporting is still required under current law. If you have any questions or concerns in the meantime, please contact your Keller account team.
