New York’s Mandatory Sexual Harassment TrainingSeptember 20, 2018
Effective October 9, 2018, the state of New York has mandated that all employers, regardless of size, provide annual sexual harassment training and a written anti-harassment policy to employees working in the state. The state recently issued employer guidance, including a model policy, complaint form, training requirements and FAQs.
The first annual employee training must be completed by January 1, 2019 for existing employees, and within 30 days of employment for new employees. The training must be interactive and include certain required elements. Keller currently provides sexual harassment training videos through HR360 at no cost to our clients. HR360 is reviewing the guidance to determine if existing videos will comply or if New York state-specific videos are necessary to meet the required elements. We will update you as we learn more.
Separately, under the Stop Sexual Harassment Act, NYC employers with at least 15 employees working in the city have additional compliance requirements:
- Post the poster in common work areas;
- Provide employees with an informational fact sheet at time of hire; and
- Provide annual training starting April 19, 2019 (that may differ slightly from the required state training).
The NYC Commission on Human Rights is creating an online training module for NYC employers that will be available at no cost.
